FOIA Appeals In a World of Diminishing Newsroom Budgets
The New York Times reported yesterday that despite reduced budgets, big media companies such as Hearst and the Associated Press continue to fund FOIA appeals and lawsuits. According to The Times, many media companies have hired in-house counsel to curtail up front, out-of-pocket costs and are aggressively pursuing statutory reimbursement (loser pays in FOIA matters). Another tactic: sending mocked up complaints as part of an administrative appeal to demonstrate that litigation is an option under serious consideration.
